The conveyance of the real estate at closing will be made and accepted subject to the existence of 24 known burial sites located northwest of main fellowship hall on the property; another potential burial site near the lake under a tree and marked with a memorial/headstone; and a final memorial/headstone that is east of the southern softball diamond, near the gravel trail. Notwithstanding the clearly marked cemetery area northwest of the main fellowship hall on the property, the Seller is not aware of whether the markers are for actual graves or just memorials near trees that have been planted. The Buyer should exercise its own due diligence and become familiar with the legal requirements for maintenance of gravesites on the property.
As it relates to the cemetery area, there is currently a vacant plot that is reserved for the wife of a previously deceased spouse. Buyer is receiving the property subject to the right of the surviving spouse to be buried next to her husband at death.
With regard to the cemetery and memorials (as applicable) Buyer will be required to grant access for ingress and egress for descendants, family members, and the general public with a request to visit the sites. To the best of Seller’s knowledge, the aforementioned individuals have a legal right of reasonable access to visit the gravesites. Buyer shall be required to not restrict reasonable ingress and egress along a designated access route (to be determined by the buyer) and shall maintain no structure or fence that impedes such visitation.
